By creating an account, subscribing to our services, or otherwise accessing the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.

2. Eligibility

To use the Platform, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Platform under applicable law

By using the Platform, you represent and warrant that you meet all eligibility requirements.

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that violate these Terms or contain inaccurate information.

Subscription Tiers

LumaResume offers the following subscription options:

• Free Tier

  Limited features with usage restrictions (5 AI requests per hour)

• Pro Tier

  Full access to all features with expanded usage limits (100 AI requests per hour)

Payment Terms

• All payments are processed securely through Stripe
• Subscription fees are billed in advance on a monthly or annual basis
• Prices are subject to change with 30 days notice to existing subscribers
• You authorize us to charge your payment method for all applicable fees

Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate.

5. Free Trial & Cancellation

Free Trial

We may offer free trials of our Pro tier. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

Cancellation

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period
• You will retain access to Pro features until the end of your paid period
• After cancellation, your account will revert to the Free tier

6. Refund Policy

All subscription fees are non-refundable. Our refund policy is as follows:

• No Refunds

  All payments are final and non-refundable. You may cancel your subscription at any time, but no refunds will be issued for unused portions of your billing period.

• Service Errors

  If you experience significant technical issues that completely prevent service use due to our fault, contact support to discuss potential account credits on a case-by-case basis.

To request a refund, contact us at support@lumaresume.com with your account email and reason for the refund request.

Your Content

You retain ownership of all content you submit to the Platform, including resumes, cover letters, and job descriptions ("User Content"). You are solely responsible for ensuring your User Content is accurate, lawful, and does not infringe on any third-party rights.

License Grant

By submitting User Content, you grant LumaResume a worldwide, non-exclusive, royalty-free license to use, process, store, and display your User Content solely for the purpose of providing and improving our services. This license terminates when you delete your User Content or close your account.

Content Responsibility

You represent and warrant that your User Content does not contain false information, violate any third-party rights, or constitute fraud. You are responsible for the accuracy and truthfulness of the information in your resumes and cover letters.

8. AI-Generated Content

• Review Required

  You are responsible for reviewing all AI-generated resumes, cover letters, and suggestions before using them

• No Guarantee of Results

  We do not guarantee that LR-AI tailored resumes will result in job interviews or offers

• Accuracy Disclaimer

  AI-generated content may contain errors or inaccuracies. Always verify the information before submitting to employers

• Professional Ethics

  You are responsible for ensuring your resume accurately represents your qualifications and experience

9. Intellectual Property

The Platform, including all software, features, designs, text, graphics, logos, and other content (excluding User Content), is owned by LumaResume and protected by intellectual property laws.

• You may not copy, modify, distribute, or create derivative works from our Platform
• You may not reverse engineer, decompile, or disassemble any part of our software
• All trademarks, service marks, and trade names are proprietary to LumaResume

You agree not to:

• Use the Platform for any illegal or unauthorized purpose
• Create resumes or cover letters containing false or misleading information
• Attempt to gain unauthorized access to other accounts or systems
• Interfere with or disrupt the Platform's operation
• Use automated systems (bots, scrapers) to access the Platform without permission
• Circumvent rate limits or usage restrictions
• Resell, sublicense, or commercially exploit the Platform
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users or our staff
• Use the Platform to generate spam or unsolicited communications

11. Third-Party Services

Our Platform integrates with third-party services including:

• OpenAI

  AI processing services

• Stripe

  Payment processing

• Google & LinkedIn

  OAuth authentication

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• That the Platform will be uninterrupted, error-free, or secure
• That results obtained from using the Platform will be accurate or reliable
• That the Platform will meet your specific requirements

You acknowledge that no advice or information obtained from LumaResume creates any warranty not expressly stated in these Terms.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMARESUME AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, goodwill, or other intangible losses
• Damages resulting from unauthorized access to your account
• Employment decisions or outcomes resulting from use of our services

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

14. Indemnification

You agree to indemnify, defend, and hold harmless LumaResume and its officers, directors, employees, contractors, agents, licensors, and suppliers from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Platform
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party

Informal Resolution

Before filing any legal claim, you agree to contact us at legal@lumaresume.com to attempt to resolve any dispute informally. We will work with you in good faith to resolve the matter within 30 days.

Binding Arbitration

If we cannot resolve a dispute informally, any claims arising from these Terms or your use of the Platform shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Class Action Waiver

YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

16. Termination

We may suspend or terminate your account and access to the Platform at any time, with or without cause, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Extended periods of inactivity

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

17. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or Platform notification at least 30 days before taking effect. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

For users located in the European Union, nothing in these Terms affects your rights as a consumer under applicable EU consumer protection laws.
